What happens if I file my 1099s late or skip them?

The IRS penalizes late 1099 filings on a per-form basis, and the penalties grow the longer you wait.

If you miss the January 31 deadline, here’s the penalty structure:

  • Within 30 days of the deadline: $60 per form
  • More than 30 days late but by August 1: $130 per form
  • After August 1 or not filed: $330 per form

These amounts are per form. Pay five contractors and file three months late? That’s $650 in penalties. Ten contractors filed after August 1? $3,300. The math adds up quickly for businesses that work with multiple vendors.

Intentional disregard carries steeper consequences. If the IRS determines you deliberately skipped filing, the penalty jumps to at least $660 per form with no maximum cap.

Filing with wrong amounts creates its own problems. Underreporting what you paid raises questions about whether you’re hiding payments. Overreporting means your contractor gets a tax bill for income they didn’t receive, which leads to disputes and corrected filings.
