How do I set up payroll for my first employee?

Start with your federal and state employer accounts. If you’ve been operating as a sole proprietor using your Social Security Number, you’ll need an Employer Identification Number from the IRS. This is free and takes about five minutes online. Once you have the EIN, register as an employer with the NY Department of Taxation and Finance for withholding tax and with the NY Department of Labor for unemployment insurance. Both registrations can be done through NY Business Express.

New York requires workers’ compensation insurance for all employers, even with just one employee. You can get coverage through a private insurer or the State Insurance Fund. Don’t skip this step because the penalties for operating without coverage in New York are serious and personal liability kicks in if someone gets hurt.

Once the registrations are handled, choose a payroll system. Options like Gusto, QuickBooks Payroll, and ADP Run are designed for small businesses and handle the calculations, tax filings, and payments automatically. They calculate withholdings based on the W-4 and IT-2104 forms your employee fills out, file your quarterly returns, deposit taxes on your behalf, and issue W-2s at year end. Monthly costs typically run $40-80 plus a per-employee fee.

Pick a pay schedule that works for your business and meets NY requirements. Office and administrative workers can be paid monthly, semi-monthly, or bi-weekly. Manual workers in New York must be paid weekly unless you have Department of Labor approval for a different schedule. Your payroll system will set up the calendar and send you reminders before each pay date.

Each pay period, you withhold federal income tax, Social Security, Medicare, and NY state income tax from your employee’s gross pay. You also pay employer portions of Social Security, Medicare, and unemployment taxes on top of that. The payroll system handles all the math so you’re not calculating withholding tables yourself.
