Does 501(c)(3) status automatically exempt my nonprofit from New York sales tax?

No. Federal 501(c)(3) status does not automatically exempt your nonprofit from New York sales tax. This is one of the most common misunderstandings among new nonprofit leaders, and it creates real problems when organizations assume they can skip sales tax without the proper state certificate.

To get sales tax exemption in New York, you need to apply separately with the New York State Department of Taxation and Finance. File Form ST-119.2, Application for an Exempt Organization Certificate. You’ll need to include a copy of your IRS determination letter confirming your 501(c)(3) status along with your organization’s formation documents.

Once approved, you’ll receive Form ST-119.1, the Exempt Organization Certificate. This is what you present to vendors when making purchases for your organization. Keep the original certificate on file and use copies when making exempt purchases. Some vendors keep your certificate on file after the first purchase while others want to see it each time.

Not everything qualifies for exemption. The exemption applies to purchases your nonprofit makes for its exempt purposes. Office supplies for running your programs, equipment for your mission, supplies for events that further your charitable work. Purchases unrelated to your exempt purpose don’t qualify even if you have the certificate.

Your organization must be registered as a nonprofit in New York and have already received your federal determination letter before you can apply. Processing takes time, so start the application as soon as you have your IRS letter rather than waiting until you need to make a large purchase.
